Withdrawal from the contract

If you are a so-called privileged buyer, that is:

A) the consumer

or

B) a natural person for whom the contract you have concluded with us is directly related to your business activity but is not of a professional nature for you

- As a general rule, you have the right of withdrawal from a distance contract.

You can withdraw from the contract by submitting to us statement of withdrawal e.g. by e-mail sent to: shop@nailsoftheday.pl.

You can withdraw from the contract within 14 days.

The 14-day withdrawal period shall begin from your taking possession of the goods or of a third party other than the carrier designated by you and, in the case of a contract which comprises multiple goods which are delivered separately, in lots or in parts, from taking possession of the last good, lot or part.

Sending the declaration before the deadline is sufficient to comply with it.

Return the goods immediately to us at the address: ul. Nowogrodzka 31/319, 00-511 Warsaw, but no later than within 14 days of the day on which you have withdrawn from the contract.

We will reimburse you the payments you have made immediately in accordance with the shop rules, but no later than within 14 days of receiving your declaration of withdrawal.

If we have not offered to collect the goods from you ourselves - we may withhold reimbursement of the payment received from you until we receive the goods back or you provide proof of return - whichever event occurs first.

Remember that you do not have the right of withdrawal from a contract concluded at a distance, among other things:

  • in which the object of the performance is non-refabricated goods made to your specifications or serving your personalised needs;
  • in which the object of the performance is an item that spoils rapidly or has a short shelf life;
  • in which the object of the service is goods supplied in sealed packaging which cannot be returned after opening for health or hygiene reasons if the packaging has been opened after delivery;
  • in which the subject matter of the performance is audio or visual recordings or computer programs delivered in sealed packaging, if the packaging has been opened after delivery.

Complaints

The following applies to a so-called privileged buyer. If you are not a privileged buyer, please refer to our shop regulations for detailed information on complaints.

In the event that we incorrectly perform the contract concluded with you, you have the right to lodge a complaint - preferably to the e-mail address: shop@nailsoftheday.pl or by mail to the address Nowogrodzka 31/319, 00-511 Warsaw.

As a general rule, we are liable for the lack of conformity of the goods with the contract, existing at the time of delivery and discovered within two years of that time.

Based on the provisions of the Consumer Rights Act, you can demand in such a situation:

(a) the exchange of goods

or

(b) repair of goods.

In some cases you may also:

(a) withdraw from the contract

or

(b) make a declaration of price reduction
